What happens in South Dakota when a private citizen creates a website to track public spending and document the secret meetings of a local road district? In a healthy democracy, you get a debate. In my County, you get the police called on you.
We are currently witnessing a disturbing evolution of the “Closed Loop.” It is no longer enough for local trustees to meet in secret, ignore state taxing statutes, and refuse to take their constitutional oaths. When a public official cannot win a debate with facts, they often turn to intimidation. Today, the target is a website about a road district. Tomorrow, it could be your post about the school board, your comments on a county zoning change, or your questions about a multi-million dollar “fee” suggested by the Auditor’s office.
Because South Dakota has no Anti-SLAPP legislation, there is no immediate shield for a citizen caught in the crosshairs of a vengeful official. These trustees know that even a meritless investigation or a frivolous lawsuit can bankrupt a regular family. They aren’t trying to win a case; they are trying to ruin a neighbor.
